COLORIN TELLS, hereinafter referred to as the ‘Company,’ through its website www.colorintells.com, will sell to any person, identified as the ‘User,’ who can acquire all kinds of goods that are published or within the affiliate program with Amazon Mexico.
Company’s Website: It is the COLORIN TELLS website, under the domain www.colorintells.com, where COLORIN TELLS publishes Sales Offers. Users can register to be redirected to the published Products and get in touch with COLORIN TELLS or Customer Service through the email colorin@colorintells.com, among other methods.
Statements:
COLORIN TELLS declares that it has all the necessary permits to fulfill its Corporate Purpose and that it does not have any impediment or limitation to fulfill the mentioned Purpose, which includes the execution of the Contract.
COLORIN TELLS grants the User a limited personal license, non-exclusive, non-transferable, revocable, for an indefinite period, according to these Terms and Conditions, to use the Site, in order to endorse, express interest in, and acquire products through Sales Offers published on the Page. The use of the Site is personal and non-transferable.
COLORIN TELLS declares ownership of the services on the Page, as well as all elements protected by intellectual property laws. All of the above is for the purpose of the Contract.
COLORIN TELLS declares to be affiliated with Amazon, so the products described on the Page may be redirected to Amazon, and COLORIN TELLS may receive a commission from Amazon in case of a purchase by the user.
COLORIN TELLS reserves all rights not expressly granted under this document.
This contract and any rights and licenses granted herein may not be transferred or assigned by the User, but COLORIN TELLS may transfer or assign them without any restriction.
The User accepts the Terms and Conditions and agrees to everything stipulated therein.
The User agrees that the warranty exclusions and limitations of liability set forth above are essential elements of the basis of these Terms and Conditions.
The User is aware that the data traffic providing access to the Site is supported by a service provided by the telecommunications service operator selected and contracted by the User, and that such contracting is entirely independent of the Site.
The User acknowledges that the commissions charged by the chosen telecommunications service operator and applicable taxes may affect the data traffic necessary for potential downloads and third-party ads on the device.
The User declares and acknowledges that downloading any content from the Site does not confer ownership of any trademarks displayed on the Site.
Restrictions:
“Any violation of these Terms and Conditions by the User will give COLORIN TELLS the right, at any time and without the need for any prior notice of any kind, to suspend or terminate the provision of services and/or to withdraw or deny access to the Site to the infringing User, as well as to remove or unregister them.
The Site may only be used for lawful purposes.
Any type of copying, distribution, transmission, retransmission, publication, printing, dissemination, and/or commercial exploitation of the material and/or content made available to the public through this Site is strictly prohibited without the prior express written consent of COLORIN TELLS or, as the case may be, the owner of the corresponding property rights. Failure to comply with this will subject the infringer to all civil claims and criminal penalties that may apply.
PARENTS OR GUARDIANS OF MINORS WILL BE RESPONSIBLE FOR ACTS PERFORMED BY THEM IN ACCORDANCE WITH THESE TERMS AND CONDITIONS, INCLUDING DAMAGES CAUSED TO THIRD PARTIES, ACTIONS PERFORMED BY THEM THAT ARE PROHIBITED BY LAW AND BY THE PROVISIONS OF THIS AGREEMENT, WITHOUT PREJUDICE TO THE RESPONSIBILITY OF THE USER, PROVIDED THAT THEY ARE NOT THE PARENT OR LEGAL REPRESENTATIVE OF THE MINOR OFFENDER.
At the time of User Registration, email addresses or any data containing expressions or graphic-denominative sets that have already been chosen by another User or are in any way injurious, offensive, coinciding with trademarks, trade names, advertisements of establishments, business names, advertising expressions, names and pseudonyms of public figures, celebrities, or registered by third parties, whose use is not authorized or is generally contrary to the law or accepted moral and ethical standards, as well as expressions that could mislead other people by mistake, will not be accepted and may be canceled at any time. It is clear that the User will be responsible for misuse in both civil and criminal matters, if applicable.
The User must not upload, publish, or in any other way make available on the Site any material protected by copyright, trademark registration, or any other intellectual property right without the prior and express authorization of the owner of said right.
Termination of Contract:
The Contract terminates when the parties fulfill their obligations.
COLORIN TELLS may terminate the Contract prematurely if:
- The Price is not paid promptly, in which case the parties expressly agree that the lack of total or partial payment will result in automatic termination.
- The User fails to comply with any of the obligations assumed in this document.
COLORIN TELLS may choose to demand the performance of its obligation to pay the price or terminate the Contract and seek compensation for damages. Additionally, it may demand compensation for damages and losses.
Validity of the Terms and Conditions
The Company, as well as the User, acknowledge that the Terms and Conditions are of unlimited duration.
COLORIN TELLS reserves the right to make alterations to this document without prior notice. Therefore, COLORIN TELLS recommends that the User regularly reread this document to stay informed about any potential modifications. The alterations to the Contract will become effective immediately after being published on the Site.
Once the modifications are made, it will be presumed that the User who continues to use the Site has full knowledge, has read, and consents to the amended Terms and Conditions.
COLORIN TELLS may unilaterally terminate this agreement, with prior notification to the User, within 1 (one) day. The notification may be, at the Company’s choice, on the Site or in writing.
If COLORIN TELLS terminates the Terms and Conditions or closes the Page, it will be after analyzing the State of the Contracts, and COLORIN TELLS will not be obligated to indemnify the User.
Jurisdiction: In case of a conflict related to the Contract, COLORIN TELLS is willing to reach an agreement with the User for conflict resolution. If there is no agreement, and in other cases not related to the Contract, the matter will be brought before the Consumer Protection Agency or the Courts of Mexico City.
Interpretation: For all matters related to the interpretation of these terms and conditions, reference will be made to the same, the glossary that you, as a user, can consult, the privacy notice, as well as all the provisions contained in these terms and conditions and our current Mexican legislation in the Federal District.
Data Protection: The data provided by the User will be processed in accordance with applicable data protection laws, to which the User gives express consent. The User may exercise their rights of access, rectification, and cancellation through written communication with the Company. The owner of personal data has the right to access them for free. For Personal Data purposes, the User must review the Privacy Notice found on the Site.
Access and Use of the Site: Both the Site and any other sites otherwise available on the Site (hereinafter the “Microsites”) are private property, and any interactions must be carried out in accordance with this document. Without prejudice to other User obligations established in these Terms and Conditions, the User agrees to (i) not use the content and products of the Site to violate the law, morals, good customs, rules and intellectual property rights, dignity, privacy, image, personal and family intimacy; (ii) observe the highest ethical and moral standards prevailing on the Internet and the applicable national and international laws: (iii) not use the User Registration, content, and products provided under these Terms and Conditions to transmit or disclose illegal, defamatory material, or abusive, threatening, obscene, harmful, vulgar, injurious or otherwise objectionable; (iv) not send unsolicited messages, recognized as spam, junk mail or chain correspondence (chain letters); not use content-type Services and products provided under these Terms and Conditions to send/disclose any type of virus or files containing any viruses or that could cause damage to the recipient or third parties; (v) comply with all applicable laws regarding data transmission from Mexico or the territory in which the User resides; (vi) not obtain or attempt to obtain access to other network systems or computers connected to the content and products of the Site; (vii) take full responsibility for the content of emails to be retransmitted, as well as the content and information made available in Site Promotions; (viii) not interfere with or disrupt the Services or servers or networks connected to the Services, content, and products supplied through the Site or Microsites; and (ix) comply with the procedures, rules, and regulations applicable to the content and products of the Site, disclosed on the pages and links of each content of the Microsites.
The User shall not send or transmit through the Site any content or information containing any propaganda or proposal related to any products and/or services. The User may not disclose or make any commercial, religious, political, or any other offer, even without commercial purposes, including but not limited to offers to Users to become Users of other services that may in any way compete with the Services provided by the Company.
Any User conduct that, in the exclusive discretion of the Company, could restrict or inhibit the use of the Site or Microsites by other Users, third parties, or COLORIN TELLS is expressly prohibited.
